Re: Appeal to High Court by Mrs Charmaine Moore  (Appeal no 2)

Our Update of 10th June reported that Mrs Moore’s appeal APP/G5180/A/10/2138442 against the refusal by LBB of her ‘Retrospective Planning Application No 10/02059, for a change of use of the site from equestrian to a gypsy and traveller caravan site’, had been dismissed by the Planning Inspector in his report issued on 9th June. A new date for the delayed County Court Injunction Hearing was expected in due course, but this has again been pre-empted and delayed by Mrs Moore’s legal adviser.

Our Councillor has now heard that Mrs Moore has submitted an appeal to the High Court against the Inspector's decision. This concerns us and will put to the ultimate test, the Government’s new Gypsy planning law, so we must trust in the efficacy of the Council's hard factual evidence to argue every point regarding Human Rights legislation, pitch quotas within the Borough, and on the highway safety problems of the access.  Bromley will have an experienced barrister specialising in Gypsy planning law to defend the Council, which should go a long way to counteract Mrs Moore’s equally experienced counsel.  We’ll inform residents when a court date is received.

Re : Planning Appeal by Charmaine Moore  Ref: APP/G5180/A/10/2138442

In respect of ‘Retrospective Planning Application No 10/02059, for a change of use of the site from equestrian to a gypsy and traveller caravan site’,

Following : Informal Appeal Hearing held on 11/05/2011 in Bromley Civic Centre, a summary of this hearing was circulated on 20th May 2011  

Decision:  The Appeal was dismissed by the Inspector in his report issued on 9th June.

The report runs to nine pages and will be posted on this website in the next few days. We have no confirmation yet, but assume that the next step in this process will be for the Court Injunction to be re-set.  Watch this space!

County Court Injunction Hearing: There is currently no date set for this.  We will report when we have more information.

Appeal Hearing - 11th May at 10am

For the many residents concerned with following, and/or contributing to, the Archie's Stables proceedings, a reminder that the Informal Hearing to determine the Appeal lodged by the owners of the site is to be conducted by the Appeal Inspector at The Civic Centre, on Wednesday 11th May, starting at 10am.

All formal related correspondence from residents will be included in the Inspector's considerations.

Charmaine Moore has appealed against the refusal of planning permission for change of use from equestrian to gypsy and traveller site.  

The appeal will now be heard by the “Secretary of State for Communities and Local Government”. Those who have previously commented on the proposal will have their comments forwarded  but the deadline for those wishing to make further or new comments is  5pm 23 February 2011.

For those wishing to comment they must send 3 copies of their letter to address below.  Please make sure to quote address and reference  number of proposal in any letters.  These are as follows – Arches Stables, Cudham Lane North, Cudham, Sevenoaks, Kent, TN14 7QT,

Another Delaying Tactic - Surprise, but no Surprise! 
 
Following their usual tactics of 'maximum delay - maximum aggravation', just days before their Injunction hearing was due to be heard in Court, the travellers have entered an appeal . 
 
The following message has just been received from our Councillor Richard Scoates:-
 
'Mrs Moore of Archies Stables has conducted a somewhat anticipated approach, and has appealed against the previous refusal, thus pushing injunction proceedings back by a month or so. The type of a appeal is that of an informal hearing for which I will be submitting an additional statement. This type of behaviour is completely unacceptable and I will be reiterating my thoughts to Bob Neil (Bromley MP and Planning Minister) to allow the Council to be more appropriately compensated for the very costly process to the tax payer'.
 
The RA too, will be submitting an additional statement.  We can only hope that the Government's forthcomimg legislation will put a stop to this type of planning abuse by travellers.
We will advise you again when we have any further news.

Archie’s Stables - TN14 7QT UPDATE  6 - 10th September 2010

 

Planning Application decision    

In Update No 5, we advised that a date of 9th September had been set for LBB Plans Committee 2 to consider the latest Planning Application for this site, namely:-

 

‘Retrospective Planning Application No 10/02059, for a change of use of the site from equestrian to a gypsy and traveller caravan site’

 

At the Meeting, this Application was refused and the Committee vote was unanimous.

 

Residents sent in 130 letters of objection to the Council, which were very effective.  This is a large number for a small village and clearly shows the strength of feeling locally.  Well done! In addition, I made a statement to the Committee, summarising the case for the residents, urging that the Application be refused and the site be restored to its original condition. Our Councillor, Richard Scoates, also very strongly supported the residents, condemning the blatant actions of the Applicant in defying Green Belt policies and the Council’s earlier decisions. 

 

County Court Injunction Hearing

This is still set for the 19th January 2011, but it could change, depending on what happens next. With the refusal of their Planning Application, we must expect that the Applicant will not just give up, but will now Appeal against decision.  How soon that happens and how long it will take for the determination of the Appeal, we cannot say, but it could delay the Hearing.

Archies Stables - TN14 7QT Update 5 - 6th September

Retrospective Planning Application No 10/02059, for a change of use to a traveller's site, 

 
Next Thursday, 9th September at 7pm  at the Civic Centre,  the Council's Plans sub-Committee No 2 will be hearing this Application for Archies Stables change of use to a traveller's site.
 
Although the Planning Dept's recommendation to the committee is to reject the proposal, supported by letters of objection from the many residents who oppose the Application, it will be best to pursue every avenue possible to ensure its rejection and the subsequent removal of the caravans and restoration of the site.  Our Councillor will be going along to speak in support of us, to keep up the pressure, and as chairman of the Cudham RA, I shall also make a brief presentation to the Committee.
 
It would therefore be beneficial if a good number of local residents could attend the public gallery, just to further emphasise the depth of feeling about this issue.   If you are able to attend the meeting, please come along, as your support will be invaluable.

Archies Stables - TN14 7QT Update 4 - 23rd August

Our last Update – No 3 – highlighted the latest situation on this site, noting the recent submission of a Retrospective Planning Application No 10/02059, for a change of use of the site from equestrian to a gypsy and traveller caravan site, and offered residents a sample letter to send to the Council for those wishing to object to this application.  These were circulated by Cudham Mailing, the RA Website and Newsletter, and, for non–RA members in the Cudham Lane N area, by a leaflet drop.  This appears to have been effective, as we believe that a large number of letters of objection have been sent to the Council.

Although Letters of Objection should have been received by the Council by Aug 19th, should you wish to comment on the Application, you may still write in, as the Council is normally willing to consider delayed comments in certain cases such as this, even if they are a bit late.

Planning Application decision date    

On Bromley’s website, the Actual Committee Date is now set for 9th Sept 2010, somewhat sooner than the end of the month, which is what we had expected. 

County Court Injunction date

At the preliminary hearing of the Injunction on 2nd Aug. it had been hoped that a date in October would be possible, but the Court Listing Office has now allocated the 19th January 2011, with a time estimate of two days and a pre-trial review on 17th December.  The review is to save time, costs and delays by ensuring that the Court is satisfied that all necessary preparatory work for the hearing has been completed. It may seem regrettable that the Hearing is to be later than hoped, but, in the event that the Council refuses the above Planning Application, the determination of any Appeal by the applicant, which could delay the Hearing, could be decided by that date.

Archies Stables TN14 7QT - Update 3

Most residents will by now be aware of the situation on the site of Archies Stables, in which Mrs Charmaine Moore and her family have taken up unauthorised residence in a mobile home, in direct contravention of a Council ruling, endorsed by the Planning Inspectorate, that residential caravans are not permitted on the site.   

County Court Injunction - A brief preliminary hearing of the Injunction was held on 2nd Aug. Mrs Moore's barrister asked for an adjournment of 6 months, which the Court refused.  Instead, a date in October seems possible, with a time estimate of two days. At the Council's request, the judge granted an Interim Order (1) forbidding the placing of any additional mobile homesor caravans, and (2) forbidding any further operational development on the site.  So these are positive points for the Council.      

Another Retrospective Planning Application - Mrs Moore is now further aggravating this situation for residents by submitting a Retrospective Planning Application for a change of use of the site from equestrian to a gypsy and traveller caravan site, with various additions.

We know that this situation is very annoying to the majority of residents who value the Green Belt and accept the decisions of the Council as the legitimate planning authority.  The Council has moved promptly in this case to start action to deal with it – and only the Council can deal with it. Long and hard experience has taught us that this type of traveller situation can only be handled (we hope successfully) through meticulous attention to the processes of the law. The law is not noted for swift action and there can also be many delays along the way, so a satisfactory resolution is likely to take a long time – but please be patient!   

How you can help - If you feel strongly about this situation and wish to make sure that your opposition is heard and taken into account, you can write and object to this, other Planning Applications and any later Appeals.  The legal  authorities are obliged to consider such objections in making their decisions.   You may wonder - “why not organise a petition?”   Well, the answer is that Individual objections from residents have proved to be much more effective. If you are concerned about what to write – such as which points are valid objections and/or most important - we can help by providing you with the necessary information, or offer you a pro-forma letter that you can use directly. 

A suggested Letter of Objection, covering the appropriate points of this Application, can be downloaded by clicking here if you wish to register your objection.  You simply need to add your own address, then date and sign it.  Of course you could compose your own letter if you prefer. All Letters of Objection must be received by the Council by Aug 19th.

Archies Stables TN14 7QT - Update 2

The last Cudham Mailing update of 26th July mentioned  that another Planning Application from Mrs Moore was expected soon. This has now appeared officially on the Bromley website and requests a lot more than just permission for a mobile home as you can see and would completely change the character fo the site.  

The Application, Ref: 10/02059/FULL.2 is for -  

"Change of use of land from equestrian to gypsy and traveller caravan site comprising1 pitch accommodating one mobile home and one touring caravan, together with additional hardstanding area, concrete post and timber panelled fence (max height 1.98m) steel gates (max height 1.98m) detached shed."

Within the next few days, the RA will advise any residents who wish to make objection to this Application, the valid grounds for objection and will offer a suggested form of letter, should you wish to make use of it, which could be used to write to the Council's planning Dept.  Any such objections will also be forwarded automatically to the Inspector if permission for the Application is refused by the Council and it then goes to Appeal. The deadline for making such objections (neighbour consultations) is 19th August 2010. 

Archies Stables TN14 7QT - Update 1

As of of 16th July, Enforcement Action and a Court Injunction against the unauthorised occupation at Archie’s Stables had been approved by the Council. Legal actions have been set in motion, and on 19th July a Court Injunction, which was considered to be the first priority, was served on Mrs Moore, against:-

    1. Unauthorised material Change of Use of the site; and

    2. Unauthorised material Development of the site

with a preliminary hearing before the Court on 2nd August, at which the course of action should be determined. Later this week, the notice of Enforcement Action will be served. As I have already advised residents, we can expect many legal tactics to be employed at every stage to delay, and try to thwart efforts to remove the caravans and return the site to normality. One such effort may soon be at hand, as Mrs Moore has already made another Application, which is currently being validated by the Council, for retrospective permission for the caravans on that site.  This will take about 8 weeks to process: if it is refused and an Appeal is lodged, that will add many more weeks and Court Action may be delayed.  And so it goes on ...

When Mrs Moore's Application is validated and published, the RA will let you know and any residents who wish to make objection to it will be advised about the valid grounds for objection, and given suggestions, if they need them, about how to proceed.
